TS-190 DECADE 50 YEAR LIMITED WARRANTY

Top Secret Coatings Inc. warrants that The Decade Deck Paint Elastomeric Acrylic Coating will last for fifty years when it is properly applied and used according to Top Secret Coatings (Decade 50 Year Deck Paint) label directions, installation instructions and standard industry practices. The 50 Year Limited Warranty is subject to Top Secret’s application instructions and recoat procedures for normal wear and tear. This Limited Warranty is limited to Decade 50 Year Acrylic Elastomeric Deck Paint only.

The Decade Deck Paint Limited Warranty is non-transferable to successive property owners. Limited Warranty excludes abuse of applied Decade Deck Paint product in any way, including but not limited to non-pedestrian traffic, burns, exposure to corrosive chemicals, spike heeled shoes, sharp or abrasive objects, excessive weights, roots and planters set directly on surface, or constant submersion (including water, snow or ice) for more than 30 days. Limited Warranty is voided if Decade Deck Paint is covered over with any paint or coating product other than Decade Acrylic Elastomeric Deck Paint (TS-190).  

 

Seller shall not be responsible for any claim resulting from failure to utilize product in the manner in which it was intended and in accordance with instruction provided for use of product. Top Secret Coatings Inc. does not guaranty results of the application, including but not limited to, appearance, watertight capabilities, slip resistance, or suitability of the surface it is applied to. Any claim for breach of warranty shall be deemed waived unless buyer shall allow seller reasonable opportunity to investigate claim and inspect product, application methods used and condition of substrate.

 

Top Secret Coatings warrants that its goods, as described on the face hereof, are free from any defects in material or workmanship. LIMITED WARRANTY SPECIFICALLY EXCLUDES ALL LABOR COSTS, PROSPECTIVE PROFITS, and ALL INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND. Seller makes no additional warranty, express or implied, and all implied warranties of merchantability and fitness for a particular purpose are hereby disclaimed. Seller’s sole liability and buyer’s exclusive remedy for breach of any warranty as expressly limited, at seller’s option, to replacement at the original F.O.B. point at no cost to original purchaser. Proof of purchase is required.
